DMCA (Digital Millennium Copyright Act) Notice

At OkiE Dairy ("we," "us," or "our"), we respect the intellectual property rights of others and expect our users to do the same. 1. Filing a DMCA Notice of Alleged Copyright Infringement

  • Contact Information: Your contact information, including your name, mailing address, telephone number, and email address.
  • Good Faith Statement: A statement that you have a good faith belief that the use of the material complained of is not authorized by the copyright owner, its agent, or the law.
  • Accuracy Statement and Perjury Acknowledgment: A statement that the information in your notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner’s behalf.

Please note: If you knowingly misrepresent that material or activity is infringing, you may be held liable for damages, including costs and attorneys’ fees, under Section 512(f) of the DMCA.


2. Counter-Notice to Restoration of Removed Content

If your content has been removed from the Site as a result of a DMCA notice, and you believe that the removal or disabling of the material was due to mistake or misidentification, you may submit a Counter-Notice to our Copyright Agent. Your counter-notice must include the following:

Required Information for a Counter-Notice:

  • Signature: A physical or electronic signature of the user who posted the allegedly infringing material.
  • Identification of the Removed Content: A description of the material that was removed or to which access was disabled, including the URL where the material appeared before it was removed.
  • Statement of Good Faith: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Consent to Jurisdiction: A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if you are located outside the United States, for any judicial district in which OkiE Dairy may be found, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

Upon receiving your counter-notice, we will promptly forward it to the original complainant. If the complainant does not file a lawsuit within 10 business days after receiving the counter-notice, we will restore the material in question.

Please note: If you knowingly misrepresent that material was removed or disabled by mistake or misidentification, you may be held liable for damages, including costs and attorneys’ fees, under Section 512(f) of the DMCA.


3. Repeat Infringers Policy

OkiE Dairy takes copyright infringement seriously. In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers.

If you believe that a user is a repeat infringer, please provide us with sufficient information to verify their infringement status so we can take appropriate action.


4. Misrepresentation of Infringement

Please be aware that under Section 512(f) of the DMCA, anyone who knowingly makes a false claim regarding copyright infringement may be liable for damages. This includes costs and attorneys' fees incurred by OkiE Dairy, the alleged infringer, or any copyright owner or licensee who is injured as a result of relying on such a misrepresentation.
